1. Who you are contracting with

The Service ("Soul Check") is operated by Monique Nolen, sole proprietor ("we", "us"). By accessing or using the Service you ("you") agree to these Terms.

2. Acceptance

Your continued use of the Service constitutes acceptance of these Terms. If you do not agree, you must stop using the Service. You must be of legal age in your jurisdiction to enter into this agreement.

3. The Service

Soul Check provides a faith-based prayer and intercession companion, including prayer chains, scripture features, minister request intake, optional 1:1 sessions, donations, and lifetime access. The Service is offered as-is for personal, spiritual support and is not a substitute for medical, mental health, legal, or financial advice. If you are in crisis, contact local emergency services.

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Provide accurate information and keep it current.

6. Intellectual property

The Service, including software, design, content, and branding, is owned by Monique Nolen or her licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not reverse engineer, resell, or redistribute the Service or circumvent its technical limits.

7. Payments and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms and our Refund Policy. Prices are shown at checkout in your local currency where supported and may change from time to time.

8. Donations

Donations made through the Service are voluntary and non-refundable except where required by law or our Refund Policy.

9. Service level and disclaimers

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at any particular time. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law (e.g., fraud, death, or personal injury caused by negligence).

You agree to indemnify and hold Monique Nolen harmless from any claims arising out of your content, your use of the Service, or your breach of these Terms.

12. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. Sections that by their nature should survive termination will survive (including IP, disclaimers, liability, and dispute resolution).

13. Changes

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date.

14. Governing law

These Terms are governed by the laws of the United States and the State in which Monique Nolen resides, without regard to conflict-of-laws rules. Disputes will be brought in the competent courts of that jurisdiction, subject to any mandatory consumer rights you have under your local law.
